This Terms of Use Agreement sets forth the standards of use of the website at www.scaleapp.tech (the “Site”) operated by SCALEAPP SINGLE MEMBER PRIVATE COMPANY (“SCALEAPP SINGLE MEMBER P.C.” or “SCALEAPP” or “we” or “us”). SCALEAPP SINGLE MEMBER PRIVATE COMPANY has its registered seat in European Union (47 Leoforos Nikis str. Thessaloniki GR54622 Greece – Greek Tax Identification Number: EL802029365 – Greek General Commercial Registry Number: 168474606000). Please read carefully this Terms of Use Agreement. By using the Site, you agree to these terms and conditions. Your continued use of the Site after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications. If you do not agree to the terms and conditions of this Agreement, you should immediately cease all usage of the Site.

A. SCOPE OF THE TERMS OF USE AGREEMENT This Terms of Use Agreement regulates the rights and liabilities regarding the use of the Site www.scaleapp.tech (including all sub-domains). The Site is not available for any financial transactions and offers only information to users about our services, projects, partnerships and our promotion.

B. WEBSITE CONTENT

B.1 Use of Material appearing on the Site We are the sole owner of all content on the Site, including, without limitation, all applicable copyrights, patents, trademarks, trade secrets, trade names, logos, and other intellectual property rights thereto, as well as text, images, graphics, logos, audio, video and other material appearing on Site. The Site and the content are protected by the copyright laws and other intellectual property laws of Greece and the European Union.

B.2 Permitted Use of Material appearing on the Site You may download and print extracts from the content for your own personal and non-commercial use only, provided you maintain and abide by any author attribution, copyright or trademark notice or restriction in any material that you download or print. You may not use any content for any other purpose without our prior written approval.

B.3 No provision of advice The Site is made available only for general, informative and promotional purposes and does not represent a recommendation and/or opinion with regard to a method of action or events published on the Site. Therefore the user is aware and agrees that any reliance on declarations, notices, publications, or any other content presented on the website is at the user’s sole discretion and sole responsibility; the user himself/herself must make all preparations and examinations with regard to that stated on the Site and is precluded from making any claim with regard to reliance on any thereof.

B.4 Links to third party webpages and websites The Site may provide users with the ability to connect to third party webpages and websites through special links (links, hyperlinks, banners) the contents of which are the exclusive responsibility of these entities. These sites are not under our control and we are not responsible in any way for any of their contents. We do not guarantee their availability and does not approve nor is liable for their contents, correctness, legality, completeness, timeliness and accuracy of information not for the quality and attributes of products or services made available by these entities through the webpages or websites above.

C. WEBSITE CONTENT We make every effort to provide valid, accurate, complete and up to date information. We also make every reasonable effort to secure a safe environment for the user of the Site , however we do not guarantee, represent or warrant that the use of the Site will be uninterrupted or error-free or free from loss, corruption, attack, viruses, interference, hacking or other security intrusion. The user must take all the necessary precautions and is solely responsible for any harm whatsoever.

USER OBLIGATIONS Users undertake that, while using the Site, they will: (i) not infringe property rights or personal non-property rights of us and/or any third parties (including intellectual property rights); (ii) not violate any applicable laws or regulations according to Greek and European Union legislation; and (iii) not upload any data that is contrary to law or contains any viruses or other computer programs or files that may interfere with the normal operation of the Site, (iv) cause damage to the Site and/or other users, or impede other users’ use of the Site. We will not be liable for any loss or damage arising from User’s failure to comply with these and/or any other safety recommendations. Non-performance of such obligations may result in an obligation to provide full compensation for any losses incurred by us.

E. AUTOMATIC DATA COLLECTION (ID ADDRESS, COOKIES, GOOGLE ANALYTICS) In some instances, we and our service providers uses cookies, web beacons and other technologies to automatically collect certain types of information when you visit us online, as well as through emails that we may exchange. The collection of this information allows us to customize your online experience, improve the performance, usability and effectiveness of our online presence, and to measure the effectiveness of our marketing activities.

E.1 IP ADDRESS An IP address is a number assigned to your computer whenever you access the internet. It allows computers and servers to recognize and communicate with one another. E.5 Social Media Widgets & Applications This Site includes plugins for the social networks Linked In, Twitter and Facebook. The plugins can be recognized by their logos. When the user visits this Site, a direct connection between the user’s browser and the Linked In, Twitter or Facebook server is established via each plugin. This enables Linked In, Twitter or Facebook to receive information that the user has visited this site from the user’s IP address. This allows each social network to associate visits to this Site with the user’s account. Please note that, as the operators of this Site, we have no knowledge of the content of the data transmitted to Linked In or Twitter or how they use these data. F. NEWSLETTERS / MAILING LISTS The user has to actively opt in or to send us an email with his/her details authorizing us to add him/her to our mailing lists and to activate his/her subscription to our Newsletter in order to provide him/her information regarding our products and services. The subscribed user may unsubscribe at any time by following the instructions included in each communication. By subscribing to our newsletter the user declares that he/she consents to the collection, organization, storage and transmission of his/her information in order to receive news, updates, offers and other information for the purpose of informing and promoting our company. We reserve the right to delete any recipient from the newsletters lists without justification.

G. ABOUT THESE TERMS We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted at the Site. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. If any provision of this Terms of Use Agreement is held to be illegal, invalid or unenforceable under any present or future Law, the remaining provisions will remain in full force and effect and will not be affected by the illegal, invalid or unenforceable provision. No failure or delay by us in exercising any right under these Terms of Agreement will constitute a waiver of that right. Both parties will act in good faith and not stand in the way of the other party's performance. This Terms of Use Agreement shall be governed by the laws of Greece. You and SCALEAPP submit to the exclusive jurisdiction of the courts of Thessaloniki (Greece) in relation to any dispute arising out of or relating to these terms.
